Social Security Fraud - Federal Court - Not Guilty

DMS, an 85-year-old retired nurse, was charged by the federal government with Theft of Government Money under 18 U.S.C. 641. Specifically, she was accused of collecting social security benefits from two separate social security numbers. The government alleged that DMS "intended to steal" the money. DMS did, in fact, have two different social security numbers, though not for fraudulent reasons.

The facts in this case were complex and convoluted. Hundreds of pages of records, spanning more than 50 years, were introduced at trial. Fortunately for DMS, none of those records showed, or even suggested, that she ever intended to steal.

The jury acquitted DMS.
