OUI-1st Offense -- Uxbridge District Court

Outcome: Motion to Suppress Allowed -- Case Dismissed

Description: Ms C and her daughter had a big fight at home. Ms C left the house and her daughter called the police; she told the police that her mom had hit her and was now driving drunk. The daughter provided the make and model of Ms C's car along with the license plate. Ms C's car was stopped in the neighboring town. Ms C was stopped only based on the call, not for any other reason. The officer who made the stop testified that he only knew of the car based on what the dispatch said. He did not know the name or identity of the initial caller. At the Motion Hearing we successfully argued that the officer did not have Reasonable Suspicion to stop the motor vehicle.
