OUI-1st Offense: Marlborough District Court - Not Guilty

Outcome: Not Guilty

Description: Mr D drove too fast, 50 mph in a 35 mph zone. He was pulled over by a local police officer. The officer noticed standard signs of alcohol impairment - slurred speech, red/bloodshot eyes, strong odor of alcohol. Mr D was asked to exit the car; when he did so he was "extremely unsteady" on his feet. According to the officer, Mr D failed all the field sobriety tests. Additionally, Mr B admitted several times that he "shouldn't have been driving" and that he "knew better." However, Mr D took the breath test and blew .07%. Rather tan take our chances with a tough judge, Mr D elected to have a jury trial. The jury found Mr D "Not Guilty."
