Negligent Operation of a Motor Vehicle -- Fall River District Court

Outcome: Complaint Not Issued

Description: Client, a 22-year-old college student, was involved in a motor-vehicle accident. His car rear-ended the car in front of him. This happened after my client pulled his car over to allow the car that was behind him to pass. After the car passed my client pulled back into traffic; as he did, the other vehicle slammed on its brakes. My client was not able to stop in time - he rear-ended the car. The driver of the other vehicle got out of his car and punched my client in the face. The other driver was subsequently charged with Assault and Battery. At a Clerk-Magistrate's Hearing, the clerk determined that there was no probable cause to issue the complaint.
