Description: Client, a 38-year-old man, was pulled over after he swerved “all over the road, going into the other lane, and crossed the marked lanes 12 times.” In addition, his two children were in the back seat. The Court issued a summons for client to appear before a clerk-magistrate for a hearing to determine whether he should be charged with the crime of Negligent Operation of a Motor Vehicle. After the hearing, the clerk decided not to issue the complaint; he was not actually charged with the crime.
