Possession of Child Pornography - Not Required to Register as Sex Offender

AJ, a 26-year-old warehouse worker, was charged with possession of child pornography. The evidence against him was strong. He had no criminal record.

AJ underwent a psychological evaluation and began sex offender treatment shortly after being charged. The doctor formed the opinion that AJ was at low risk for re-offense. Because of the strength of the evidence against him, AJ agreed to plead guilty. AJ's primary concern was being required to register as a sex offender. At sentencing, Attorney Fasoldt submitted the evaluation to the judge. The judge sentenced AJ to probation.

Next, attorney Fasoldt filed a "Motion for Relief From Registration." This motion may not be filed until after the individual is sentenced. This means that there is no guarantee that the judge will grant the motion. Fortunately, the judge agreed with the motion and relieved AJ from registering as a sex offender.
