OUI-2nd Offense -- Salem District Court

Outcome: Not Guilty

Description: Client, a 30-year-old food service manager, was stopped for speeding. His driving was otherwise normal. When asked, he provided his license and registration without issue. He exited his vehicle easily, but was unsteady as he walked to the rear of his car. Standard signs of impairment were detected by the officer -- slurred speech, bloodshot eyes, strong odor of alcoholic beverage. The officer conducted Field Sobriety Tests on the road (a busy major local highway). Client was arrested. At a jury trial, Henry was able to show that there was significant doubt about whether the client was impaired. The jury agreed. Client was acquitted.
