Outcome: Dismissed

Description: Client, a 65-year-old female w/ diabetes and poor balance, was pulled over b/c her lights were not on. She failed field sobriety tests and was unable to provide a valid breath sample at the station. Recognizing that the symptoms of alcohol impairment were really just symptoms of her health condition, the ADA agreed to dismiss the charge as part of a plea deal involving another less serious charge. Client's license was reinstated after the dismissal.
