Outcome: Motion to Suppress allowed. Case Dismissed
Description: Client, a 28-year-old construction project manager, was pulled over because the police officer thought that client's headlights were not on. This was not true. Client's headlights were illuminated. Client testifed at a Motion to Suppress that his car's "daytime running lights" are on when the car's engine is on. In our supplemental memoranda we showed the judge the manual to the vehicle, which proved our position. The judge agreed, and held that the police did not have reasonable suspicion to pull over my client. Motion to Suppress allowed. Case dismissed
