Malicious Destruction of Property -- Roxbury Court

Outcome: Pretrial Probation - case to be dismissed if client stays out of trouble for one year

Description: Boston police responded to a 911 call for reported "Domestic Violence in Progress." They arrived at the house of Mr B's fiancé and were given entry to the home by the fiancé's roommate. The roommate called the police initially. Inside the home they noticed that several household items had been turned over and/or broken. Mr B and his fiancé denied that any physical altercation took place. However, the police charged Mr B with Malicious Destruction of Property. The prosecutor in this case felt very strongly that Mr B's fiancé was in an "abusive relationship." This, of course, was not true. Eventually, the prosecutor offered to dismiss the case if Mr B does not get in trouble for one year.
